These Terms and Conditions govern your access to and use of https://caldwellroofing.com/ and any related pages, features, content, forms, and online services operated by Caldwell Roofing Co., Inc., a Florida corporation. In these Terms, “Caldwell Roofing,” “we,” “us,” and “our” refer to Caldwell Roofing Co., Inc., and “Site” refers to https://caldwellroofing.com/.

Caldwell Roofing is a State of Florida Certified Roofing Contractor, license number CCC-033696, with an office at 103 NW 43rd Street, Suite A, Boca Raton, Florida 33431.

Please read these Terms carefully. By accessing or using the Site, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Site.

1. Purpose of the Site

The Site provides general information about Caldwell Roofing, roofing systems, roof replacement, roof repairs, roof pressure cleaning, maintenance, material and design selection, service areas, project processes, permitting, inspections, and related roofing topics.

Site content is provided for general informational and promotional purposes. It is not a substitute for an on-site roof evaluation, professional engineering advice, legal advice, insurance advice, or a written agreement with a licensed contractor. Descriptions of services, photographs, project examples, statistics, testimonials, educational materials, and other content do not constitute a binding offer, guarantee of availability, representation about the condition of a particular property, or promise of a particular result.

2. Acceptance and Eligibility

By using the Site, you represent that you are legally capable of agreeing to these Terms. If you use the Site on behalf of a company, property owner, condominium association, homeowners association, trust, or other organization, you represent that you are authorized to act for that party in connection with your use of the Site.

The Site is not directed to children under 13. Individuals under the age of majority should use the Site only with the involvement and permission of a parent or legal guardian. Only a person with legal authority to bind the applicable property owner or customer may approve a proposal or enter into a contract for roofing services.

3. Requests for Information, Assessments, and Quotes

You may use the Site to request information, ask a question, request an assessment, or seek a quote. Submitting a form, calling Caldwell Roofing, sending an email, discussing a project, scheduling an initial visit, or receiving preliminary information does not create a contractor-client relationship, reserve labor or materials, or obligate Caldwell Roofing to perform services.

A roofing project becomes binding only when the parties complete the acceptance requirements stated in the applicable written proposal or contract. Those requirements may include signatures, written confirmation, payment of a deposit, confirmation of product selections, approval by an architectural review body, or other project-specific steps.

The scope of work, price, payment schedule, estimated timing, materials, warranties, exclusions, change-order procedures, cancellation terms, permit responsibilities, inspection requirements, access requirements, and other project conditions will be stated in a separate proposal, contract, change order, invoice, warranty document, or written confirmation. If these Terms conflict with a signed agreement for roofing services, the signed agreement controls with respect to those services.

Caldwell Roofing may accept or decline any request for an assessment, quote, or project, subject to applicable law.

4. Estimates, Pricing, Schedules, and Availability

Any pricing, cost statistics, project values, timelines, or other figures displayed on the Site are general information only. They are not a quote for your property. Roofing costs and schedules may vary based on roof size, pitch, access, existing conditions, deck condition, code requirements, permitting, inspections, material availability, manufacturer requirements, association approvals, weather, and other project-specific factors.

A quote is valid only for the period and scope stated in the written quote. Unless Caldwell Roofing confirms otherwise in writing, an inquiry, assessment request, preliminary discussion, or unsigned quote does not reserve a start date, crew, product, color, or material.

Project schedules may be affected by weather, government processing times, required inspections, material supply, unsafe site conditions, concealed damage, change orders, or events outside Caldwell Roofing’s reasonable control. Any estimated schedule provided through the Site or during an initial discussion is not a guarantee.

5. SMS Messaging Program

Program Description and Messaging Use Cases

When you affirmatively opt in, Caldwell Roofing may send recurring text messages to the mobile telephone number you provide. The Caldwell Roofing SMS program may be used for:

  • Responding to requests for information or customer support.
  • Scheduling or confirming roof assessments, inspections, appointments, and project visits.
  • Sending estimate reminders and follow-up communications.
  • Providing project status, permit, inspection, material, delivery, or weather-related scheduling updates.
  • Sending invoice, payment, warranty, or service reminders.
  • Sending marketing or promotional messages when you separately consent to receive them.

Message frequency varies based on your requests, project activity, and the type of messages you authorized. Consent to receive marketing text messages is not a condition of purchasing goods or services from Caldwell Roofing.

Eligibility and Age Restriction

You must be at least 18 years old and the authorized user of the mobile telephone number provided to enroll in the SMS program. By opting in, you represent that you satisfy these requirements and are authorized to consent to messages sent to that number.

Opting Out

You may opt out at any time by replying STOP to any Caldwell Roofing text message. You may also use another reasonable method to communicate that you no longer wish to receive messages, including calling 561-392-0971.

After an opt-out request, Caldwell Roofing may send one final text confirming that the request was processed. No additional marketing texts will be sent unless you provide new consent. Opting out of text messages does not prevent Caldwell Roofing from contacting you through another method when necessary to respond to a request, administer a contract, provide requested services, or comply with law.

Message and Data Rates

Message and data rates may apply to each text message sent or received under your wireless service plan. Caldwell Roofing does not charge a separate fee for participating in the SMS program. Contact your wireless carrier for information about your messaging and data plan.

Carrier Disclaimer

Wireless carriers are not liable for delayed, undelivered, or misdirected messages. Message delivery is subject to effective transmission by your carrier and is not guaranteed. The SMS program may not be available through every carrier, device, or service plan.

Mobile Number Changes

You agree to notify Caldwell Roofing or opt out before transferring, discontinuing, or changing the mobile number enrolled in the SMS program. You are responsible for keeping your contact information current.

Privacy

Our collection and use of information associated with the SMS program is described in our Privacy Policy. Mobile numbers, SMS opt-in records, and text-message consent are not sold, rented, or shared with third parties or affiliates for their own marketing or promotional purposes.

6. Roofing Information and Property Conditions

Roofing systems vary by property, age, installation method, exposure, maintenance history, prior repairs, structural condition, and applicable building requirements. Information that may be generally accurate for South Florida homes or a particular roofing material may not apply to your roof.

The Site cannot detect leaks, concealed moisture, deteriorated underlayment, rotten decking, structural movement, code deficiencies, mold, electrical hazards, asbestos-containing material, or other conditions that may require physical access, testing, destructive investigation, engineering review, or specialized professional services.

Do not climb onto a roof or enter an unsafe area based on information found on the Site. Roof access can involve serious risks, including falls, unstable surfaces, sharp materials, heat exposure, electrical contact, and falling objects. Contact a qualified professional when an inspection or repair is needed. If there is an active emergency, fire, structural failure, downed electrical line, or immediate threat to people or property, contact the appropriate emergency service or utility provider.

7. Permits, Codes, Associations, Insurance, and Incentives

The Site may discuss building permits, inspections, building codes, product approvals, insurance considerations, architectural review requirements, financing, tax matters, rebates, or incentives. Requirements and programs can change, differ by jurisdiction or property, and depend on facts not available through the Site.

Caldwell Roofing does not guarantee that Site content reflects every current rule, program, insurer requirement, association restriction, or eligibility condition. You remain responsible for confirming matters that fall outside the scope of a signed roofing agreement, including insurance coverage, policy terms, financing terms, tax consequences, association approvals, and legal requirements applicable to your property.

Caldwell Roofing is not a public adjuster, insurer, attorney, engineer, tax advisor, or financial advisor unless a separate written disclosure expressly states otherwise. Nothing on the Site should be treated as advice from one of those professionals.

8. Information and Materials You Submit

When contacting Caldwell Roofing, you may submit information such as your name, phone number, email address, property address, service needs, project details, messages, photographs, videos, plans, product preferences, or documents.

You represent that the information you provide is accurate to the best of your knowledge, that you have the right to provide it, and that your submission does not violate another person’s rights or applicable law. You retain any ownership rights you have in submitted materials. You grant Caldwell Roofing a limited, nonexclusive right to receive, store, review, reproduce, and use those materials as reasonably necessary to respond to your inquiry, evaluate the requested work, communicate with you, protect the Site, maintain business records, and perform services you later authorize.

Photographs, videos, measurements, plans, and descriptions submitted through the Site may assist with an initial review, but they do not replace an on-site assessment and may not reveal concealed or unsafe conditions.

Do not submit Social Security numbers, payment card information, bank account credentials, medical records, passwords, government identification numbers, or other highly sensitive information through a general contact form. Submitting an inquiry does not create a confidential, fiduciary, or exclusive relationship.

9. Intellectual Property

The Site and its content, including text, photographs, graphics, logos, illustrations, videos, layouts, roof diagrams, guides, databases, compilations, and design elements, are owned by or licensed to Caldwell Roofing and are protected by copyright, trademark, and other intellectual property laws.

Subject to these Terms, Caldwell Roofing grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Site for personal, noncommercial informational purposes. You may print or save a reasonable number of Site pages for your own evaluation of Caldwell Roofing’s services, provided that you do not remove proprietary notices or alter the content.

Without prior written permission from the applicable rights holder, you may not copy, reproduce, republish, distribute, sell, license, publicly display, modify, create derivative works from, scrape, download in bulk, frame, mirror, or commercially exploit Site content. You may not use Caldwell Roofing’s name, logo, photographs, or other branding in a manner that suggests sponsorship, endorsement, affiliation, or authorization.

No use of the Site transfers ownership of any Site content, proposal format, roof design, specification, photograph, drawing, guide, or other material. Ownership and permitted use of project-specific documents and deliverables are governed by the applicable written agreement.

10. Acceptable Use

You may not use the Site to:

  • Violate any law or the rights of another person.
  • Submit false, misleading, fraudulent, threatening, harassing, defamatory, obscene, or unlawful material.
  • Impersonate another person or misrepresent your identity, authority, affiliation, or relationship to a property.
  • Introduce malware, malicious code, or other harmful technology.
  • Attempt to gain unauthorized access to the Site, its systems, or information associated with another person.
  • Interfere with the Site’s operation, security, availability, or performance.
  • Use automated tools to scrape, harvest, monitor, or extract Site content or personal information without written permission.
  • Use Site content to train an artificial intelligence system or create a competing commercial product without written permission.
  • Use the Site to submit unsolicited advertising, spam, or fraudulent requests.

11. Third-Party Services and Links

The Site may be hosted, measured, secured, or supported by third-party providers. It may also contain links to manufacturers, suppliers, social media platforms, mapping services, review platforms, government agencies, associations, financing providers, or other websites and services not controlled by Caldwell Roofing.

Third-party services have their own terms and privacy practices. Caldwell Roofing is not responsible for their availability, security, accuracy, content, products, services, or practices. A link, logo, reference, or integration does not necessarily constitute an endorsement or warranty. Your use of a third-party service is at your own risk and is governed by that provider’s terms.

References to manufacturers, products, certifications, associations, and suppliers are provided for identification and informational purposes. Product availability, specifications, colors, warranties, approvals, and installation requirements are controlled by the applicable manufacturer or authority and may change.

12. Testimonials, Reviews, Project Images, and Statistics

Testimonials, reviews, ratings, project photographs, case examples, and descriptions reflect individual experiences or past work. They do not guarantee that another property owner or project will receive the same result. Outcomes vary based on property conditions, selected materials, maintenance, weather exposure, code requirements, project scope, and other factors.

Unless expressly identified otherwise, project images are illustrative and may not depict every component, stage, or condition relevant to a roofing system. Colors and textures may appear differently based on lighting, photography, display settings, manufacturing variations, and installation context.

Permit counts, declared job values, medians, cost data, and other statistics may come from government records or other third-party sources. Such data may be incomplete, delayed, revised, or based on reporting conventions that do not represent final customer prices. Statistical information is not a quote, appraisal, valuation, or prediction for your property.

13. Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content are provided “as is” and “as available.” Caldwell Roofing disclaims all express and implied warranties relating to the Site, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, accuracy, availability, security, and uninterrupted operation.

Caldwell Roofing does not warrant that the Site will be error-free, that defects will be corrected, that information will always be current or complete, that the Site will always be available, or that the Site or its servers will be free of harmful components.

This disclaimer applies to the Site and its content. It does not replace or alter any express workmanship warranty, manufacturer warranty, or other obligation stated in a signed agreement for roofing services.

Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

14. Limitation of Liability

To the fullest extent permitted by law, Caldwell Roofing Co., Inc. and its officers, directors, employees, representatives, and agents will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages arising from or relating to the Site, including loss of data, revenue, profits, opportunities, goodwill, use, or business interruption.

To the fullest extent permitted by law, the total liability of Caldwell Roofing and the related parties identified above for all claims arising from or relating solely to the Site will not exceed one hundred dollars.

This limitation applies only to claims relating to the Site. Liability associated with an assessment, roof access, completed repair, roof replacement, cleaning service, or other contracted service may be addressed in the applicable signed agreement, warranty, or other project document. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, Caldwell Roofing’s liability will be limited to the greatest extent permitted by law.

15. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Caldwell Roofing Co., Inc. and its officers, directors, employees, representatives, and agents from claims, liabilities, damages, judgments, losses, and reasonable costs, including reasonable attorneys’ fees, arising from your unlawful use of the Site, violation of these Terms, violation of another person’s rights, or materials you submit through the Site.

16. Copyright Concerns

If you believe content on the Site infringes your copyright, send Caldwell Roofing a written notice. The notice should identify the copyrighted work, identify the allegedly infringing material and its location on the Site, provide your contact information, state your good-faith belief that the use is unauthorized, state that the information in the notice is accurate, and include your physical or electronic signature.

Notices may be mailed to the address listed in Section 20.

17. Changes to the Site or These Terms

Caldwell Roofing may update, suspend, restrict, or discontinue any part of the Site at any time. Caldwell Roofing may also revise these Terms. A revised version will be posted on this page with an updated “Last Updated” date. Changes apply prospectively when posted unless a later effective date is stated.

Your continued use of the Site after revised Terms become effective constitutes acceptance of the revised Terms.

18. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any legal action arising from or relating to the Site or these Terms must be brought in a state court located in Palm Beach County, Florida, or, when federal jurisdiction exists, in the United States District Court serving Palm Beach County. You consent to the personal jurisdiction and venue of those courts.

19. General Terms

If any provision of these Terms is found unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in effect. Caldwell Roofing’s failure to enforce a provision is not a waiver of that provision.

You may not assign your rights or obligations under these Terms without Caldwell Roofing’s written consent. Caldwell Roofing may assign these Terms as part of a merger, sale, reorganization, or transfer of its business or assets.

These Terms and the Privacy Policy constitute the entire agreement between you and Caldwell Roofing concerning use of the Site. Separate written agreements govern roofing projects and any other matters expressly covered by those agreements.
